1. Agreement to Terms

By accessing or using SwasthyaAI's healthcare management platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

SwasthyaAI provides a cloud-based healthcare management platform that includes patient management, electronic medical records, appointment scheduling, billing, pharmacy management, laboratory information systems, and related healthcare administration tools.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years old
  • Be a licensed healthcare provider or authorized representative of a healthcare facility
  • Have the authority to bind your organization to these Terms
  • Provide accurate and complete registration information

4. User Accounts

4.1 Account Creation

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2 Account Security

You must immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to comply with these security obligations.

5. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Violate patient privacy or confidentiality obligations
  • Share login credentials with unauthorized individuals
  • Attempt to gain unauthorized access to any part of the Service
  • Transmit any viruses, malware, or other malicious code
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute the Service without authorization

6. Healthcare Compliance

6.1 Your Responsibilities

As a healthcare provider, you are responsible for:

  • Obtaining patient consent for data collection and processing
  • Ensuring accurate and complete medical documentation
  • Complying with all applicable healthcare laws and regulations
  • Maintaining appropriate medical licenses and certifications

6.2 Our Role

SwasthyaAI acts as a data processor on your behalf. We provide tools to help you comply with regulations, but the ultimate responsibility for compliance rests with you.

7. Subscription and Payment

7.1 Fees

You agree to pay all fees associated with your selected subscription plan. Fees are billed in advance on a monthly or annual basis.

7.2 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel at any time through your account settings.

7.3 Refunds

Annual subscriptions are eligible for a pro-rated refund within the first 30 days. Monthly subscriptions are non-refundable.

8. Data Ownership

You retain all ownership rights to your data, including patient records and facility information. We do not claim any ownership rights over your content.

You grant us a limited license to host, store, process, and display your data solely to provide the Service.

9. Data Export and Portability

You may export your data at any time through the Service. Upon account termination, we will provide a data export within 30 days upon request.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.

11. Intellectual Property

The Service, including its software, design, and documentation, is owned by SwasthyaAI and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWASTHYAAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold SwasthyaAI harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

Either party may terminate this agreement with 30 days written notice. We may immediately suspend or terminate your account for violation of these Terms.

15. Modifications

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Mumbai, Maharashtra.
